F-814: Food from Unsafe Sources – It’s Not Just About Vendors

When it comes to food safety, F-814 is the line CMS doesn’t want you to cross. This regulation prohibits serving any food or beverage that is from an unapproved or unsafe source, including donations, home-cooked goods, or improperly labeled items.

Citations here can trigger immediate jeopardy findings if resident health is at risk.

 

What Does F-814 Require?

Facilities must ensure that:

  • All food is obtained from sources that comply with state and federal regulations

  • Donated or home-prepared food is not served unless permitted and documented per policy

  • All items are properly labeled, stored, and tracked back to their source if needed

  • Vendors meet food safety standards and deliver per protocol

 

Common Survey Triggers for F-814:

  • Serving food brought in by family without verifying safety or labeling

  • Using unlabeled or repackaged items from unknown origins

  • Accepting food donations (e.g., pastries, fruit, catered meals) without proper documentation

  • Failing to ensure vendors meet food safety and delivery standards

  • Using expired or spoiled food that poses a health risk

 

Smart Tips for F-814 Compliance:

  1. Establish a Clear “Outside Food” Policy
    Families should be informed of what’s allowed, what’s not, and how to store or label food if permitted.

  2. Train Staff to Say No—Politely and Legally
    Staff should know how to redirect well-meaning family members offering food for communal use or gifts for the kitchen.

  3. Vet and Document All Vendors
    Keep updated records of licenses, inspections, and product traceability for every food supplier or distributor.

  4. Avoid Homemade Items for Group Service
    Even if a resident is allowed to have food from home, never serve homemade items to other residents unless approved under your policy.

  5. Document Exceptions Clearly
    If food is served outside the standard procurement process (e.g., cultural dishes, end-of-life requests), document IDT involvement and safety considerations.
